PRIVACY E COOKIE POLICY APP BADAPLUS

Questa Privacy e Cookie Policy ha lo scopo di descrivere le finalità e le modalità tramite cui Openjobmetis S.p.A. con sede legale in Milano, Via Bernardino Telesio 18, in qualità di Titolare del trattamento (“Società” o “Titolare”), raccoglie e tratta i dati personali relativi all’utente (”Utente/Utenti”) che interagisce con l’App “BADAPLUS” (“App”).
L’App “BADAPLUS” (“App”), gestita da Openjobmetis è una piattaforma avente la finalità di agevolare l’incontro tra domanda ed offerta di lavoro, consentendo agli Utenti-Famiglie (vale a dire i clienti di Openjobmetis che aderiscono al servizio), previo download e registrazione del proprio account, di promuovere la fornitura di manodopera per l’esecuzione di una Missione in somministrazione, che verrà proposta ad Utenti-Lavoratori (vale a dire i candidati alle offerte di missione proposte dagli Utenti-Famiglie per il tramite di Openjobmetis e che aderiscono al servizio) selezionati dal sistema in relazione alle caratteristiche professionali, di reperibilità e di luogo fisico di rifermento.
Le informazioni contenute nella presente Privacy e Cookie Policy sono fornite ai sensi del Regolamento UE del 27 aprile 2016 n. 679 (“Regolamento”), del D. Lgs. 196/2003 (“Codice Privacy”), nonché dei Provvedimenti emanati dall’Autorità Garante per la protezione dei dati personali (“Garante”) e delle Linee Guida delle autorità europee.
Le informazioni circa il trattamento dei dati sono rese solo per l’App e per il trattamento operato dalla Società e non si estendono ai trattamenti operati da soggetti terzi tramite altri siti eventualmente consultabili dall’Utente tramite link. Rispetto a detti ulteriori trattamenti la Società non si assume alcuna responsabilità, dovendo l’Utente far riferimento alle singole Privacy e Cookie Policy dei siti terzi.

1. Titolare del trattamento

Il Titolare del trattamento è la Società, come indicata in epigrafe.

2. Finalità e base giuridica del trattamento

La Società nell’ambito dell’erogazione e dell’utilizzo dell’App, potrà trattare i dati degli Utenti-Famiglie e degli Utenti-Lavoratori per le seguenti finalità.
a)   Selezione degli Utenti-Lavoratori per determinarne le caratteristiche personali e qualifiche professionali e la conseguente eleggibilità per l’attivazione e utilizzo dell’App da parte degli stessi.
b)   Attivazione e gestione operativa dei servizi offerti dall’App (es. registrazione degli Utenti, creazione degli account, pubblicazione degli annunci relative alle offerte di missione direttamente da parte degli Utenti-Famiglie, candidature da parte degli Utenti-Lavoratori).
c)   Attivazione del profilo, anche rispetto all’uso della firma elettronica anche ai fini della gestione delle relative finalità amministrativo-contabili.
d)   Gestione degli storici rispetto al profilo di ciascun Utente-Famiglie e Utente-Lavoratore.
e)   Invio di notifiche da parte dell’App con riferimento alle offerte di missione presentate dall’Utente-Famiglie ed alle relative candidature proposte da ciascun Utente-Lavoratore, via push sul telefono cellulare dell’Utente o via email all’indirizzo indicato in sede di creazione dell’account, ove l’Utente abbia attivato queste opzioni.
La base giuridica dei citati trattamenti è l’esecuzione del servizio da Lei richiesto.
f)   Perseguimento dei legittimi interessi dei Titolari e/o di terzi (ad esempio, il diritto di difesa in giudizio, la gestione dei reclami e del contenzioso, l’eventuale recupero dei crediti, la prevenzione di frodi e/o di attività illecite), che rappresentano la base giuridica del trattamento.
g)   Finalità connesse all’esecuzione di obblighi di legge, regolamenti, normative nazionali e comunitarie nonché derivanti da disposizioni impartite da autorità a ciò legittimate dalla legge che costituiscono la base giuridica del trattamento.
h)   Finalità statistiche, finalità di analisi circa l’uso e le funzionalità dell’App.

3. Categorie di dati oggetto di trattamento

Openjobmetis ricevere e raccogliere dati personali e informazioni relative agli Utenti-Ristoratori ed Utenti-Lavoratori che accedono all’App e che usufruiscono dei servizi in essa disponibili, anche inserendo e condividendo tra gli Utenti informazioni ed immagini. In particolare, Openjobmetis tramite l’App potrà acquisire e trattare le seguenti informazioni.

3.1 Dati raccolti tramite la navigazione e tramite cookie

Quando gli Utenti visitano e utilizzano l’App, quest’ultima raccoglie alcuni dati quali le funzionalità e i contenuti a cui gli Utenti hanno avuto accesso, i collegamenti o i pulsanti cliccati, la data e l’ora di accesso, l’indirizzo IP del dispositivo, il sistema operativo utilizzato (c.d. “dati di navigazione”). I dati di navigazione potrebbero, per loro stessa natura, permettere di identificare gli Utenti anche attraverso elaborazioni e associazioni con dati detenuti da terzi. Tuttavia, Openjobmetis utilizza questi dati al solo fine di ricavare informazioni statistiche e anonime sull’uso dell’App per finalità strettamente legate al funzionamento della stessa.
In secondo luogo, in relazione alla raccolta di dati dell’Utente attraverso cookie e tecnologie simili, si prega di visitare la sezione 7 di questa Policy.

3.2 Dati forniti volontariamente dall’Utente

Gli Utenti-Lavoratori e Famiglie decidono, a loro insindacabile giudizio, rispettivamente, se candidarsi o meno per una richiesta di missione o se accettare o meno una candidatura. La preliminare acquisizione dei dati identificativi degli Utenti-Famiglie e degli Utenti Lavoratori, forniti volontariamente in sede contrattuale, avviene presso le sedi di Openjobmetis alla presenza di personale della medesima incaricato in modo da delineare il profilo degli Utenti e consentire la relativa creazione dell’account, attivato personalmente da ciascun Utente.

Nell’ambito dei servizi offerti dall’App, gli Utenti potranno fornire ulteriori dati personali, oltre a quelli indicati per le finalità di cui sopra, ad esempio informazioni rese al fine di ricevere chiarimenti, servizi di assistenza etc. (per esempio richiedere informazioni, segnalare disservizi o malfunzionamenti, etc.). Tali dati saranno trattati da Openjobmetis per consentire il riscontro alle richieste degli Utenti. Il mancato conferimento può comportare l’impossibilità di ottenere il servizio richiesto.

4. Comunicazione dei dati a terzi

I dati forniti dall’Utente nonché quelli raccolti dall’App nell’ambito dei relativi servizi (es. indirizzo IP) non saranno diffusi e potranno essere comunicati, per le finalità e modalità illustrate nella presente Privacy e Cookie Policy, alle categorie di soggetti di seguito indicate:

•   a società del Gruppo Openjobmetis, per finalità amministrative, per il perseguimento dei legittimi interessi della Società e/o di terzi e per finalità di esecuzione dei servizi espressamente richiesti dall’Utente;
•   nel caso di Utente-Famiglia, candidati per la posizione lavorativa eventualmente offerta dall’Utente e/o lavoratori somministrati della Società, della cui attività lavorativa l’Utente intenda avvalersi;
•   società, collaboratori, consulenti o liberi professionisti di cui la Società si avvale per lo svolgimento di compiti di natura tecnica o organizzativa (quali ad esempio i fornitori di servizi IT), o con cui la Società collabora ai fini della erogazione e funzionamento dei propri servizi, o per eventuali attività di comunicazione;
•   persone, società o studi professionali che prestino attività di assistenza e consulenza alla Società, con particolare, ma non esclusivo, riferimento alle questioni in materia contabile, amministrativa, legale, tributaria e finanziaria;
•   soggetti cui la facoltà di accedere ai dati sia riconosciuta da disposizioni di legge o da ordini delle autorità.
I soggetti appartenenti alle categorie sopra indicate utilizzeranno i dati in qualità di autonomi titolari del trattamento ai sensi di legge o di responsabili del trattamento di dati regolarmente nominati dalla Società.
Tali soggetti potranno essere stabiliti in Italia e/o Paesi UE.
L’elenco dei soggetti a cui i dati sono o possono essere comunicati possono essere richiesti alla Società inviando una mail all’indirizzo privacy@openjob.it.
5.   Conservazione dei dati

I dati dell’Utente saranno conservati per il tempo necessario al perseguimento delle finalità per le quali sono stati raccolti e per lo svolgimento delle attività connesse e strumentali alle stesse, come indicate al precedente paragrafo 2, dopodiché saranno conservati nel rispetto dei termini di prescrizione ordinaria individuati dal Codice Civile o da specifiche disposizioni di legge, per finalità di tipo amministrativo e/o per far valere o difendere un diritto o un interesse legittimo e gli stessi verranno cancellati al venir meno degli scopi per i quali sono stati raccolti.
In secondo luogo, i dati personali raccolti per le finalità di valutazione delle candidature in relazione a posizioni interne alla struttura di Openjobmetis saranno conservati per 12 mesi dal conferimento degli stessi.
Infine, i dati raccolti per le finalità di invio di newsletter sono conservati fino all’eventuale disiscrizione/opposizione dell’Utente.
Al termine di detti periodi, i dati saranno conservati in forma anonima per finalità di analisi e statistiche.

6. Diritti

L’Utente può esercitare, nei casi espressamente previsti dalla legge e ove applicabili, i diritti previsti dal Regolamento. In particolare, l’Utente ha il diritto di:
   chiedere la conferma che sia in corso il trattamento dei suoi dati personali e, in tal caso, chiedere al Titolare l’accesso alle informazioni relative al trattamento medesimo (es. finalità, categorie di dati trattati, destinatari o categorie di destinatari dei dati, il periodo di conservazione, etc.);
   chiedere la rettifica dei dati inesatti o incompleti;
   chiedere la cancellazione dei dati;
   chiedere la limitazione del trattamento.
   ricevere, in un formato strutturato, di uso comune e leggibile da dispositivo automatico, i dati personali che lo riguardano e trasmetterli ad un altro titolare, o chiedere la trasmissione diretta da un titolare all’altro, se tecnicamente fattibile (c.d. “portabilità dei dati”);
   revocare in qualsiasi momento il consenso prestato, senza pregiudicare la liceità del trattamento basata sul consenso prestato prima della revoca.

L’Utente ha, inoltre, il diritto di opporsi in tutto o in parte, per motivi legittimi, al trattamento dei dati personali che lo riguardano, oltre che il diritto di opporsi in qualsiasi momento alle finalità di marketing (incluso parzialmente per singoli canali).

Tali diritti sono esercitabili direttamente inviando una comunicazione al seguente indirizzo email: privacy@openjob.it.

Infine, qualora ritenga che il trattamento dei dati forniti violi la normativa in materia di protezione dei dati personali, l’Utente ha il diritto di proporre reclamo all’Autorità Garante per la protezione dei dati personali (www.garanteprivacy.it ).

7. Raccolta di dati tramite Cookie

Un cookie è una stringa di testo di dimensioni ridotte che i siti visitati inviano al browser del computer dell’Utente, ove vengono memorizzati quando quest’ultimo visita un sito internet, per essere poi ritrasmessi agli stessi siti alla visita successiva.
I cookie vengono utilizzati dalla Società per far funzionare il Sito o per migliorarne le prestazioni, ma anche per fornire informazioni sul Sito o sulla navigazione dell’Utente.
Il Sito utilizza cookie sia per finalità tecniche che per finalità ulteriori: mentre i cookie tecnici sono utilizzati in quanto strettamente necessari al funzionamento tecnico del Sito nonché a fornire il servizio espressamente richiesto dall’Utente (es. impostazione della lingua, etc.), come di seguito meglio illustrati, i cookie per finalità ulteriori (es. cookie analitici) sono utilizzati per svolgere analisi comportamentali dell’Utente sul Sito, come di seguito indicato.

Ad integrazione di quanto specificato Policy privacy, si riportano di seguito le informazioni relative al trattamento dei cookies all’interno dell’App.

In linea di massima, l’App utilizza cookies sia per finalità tecniche che per finalità ulteriori: mentre i cookies tecnici sono utilizzati in quanto strettamente necessari al funzionamento tecnico dell’App, nonché a fornire il servizio espressamente richiesto dagli Utenti (es. autenticazione, impostazione della lingua, etc.), come di seguito meglio illustrati, i cookies per finalità ulteriori (es. cookies analitici) sono utilizzati per svolgere analisi comportamentali degli Utenti sull’App, al fine di migliorarne i contenuti e monitorare le preferenze manifestate dagli Utenti nell'ambito dell’utilizzo dell’App, come di seguito indicato.

Cookies Tecnici

I cookies tecnici sono fondamentali per permettere all’Utente di muoversi all’interno dell’App e per usare le sue funzionalità, quali ad esempio accedere all’account degli Utenti (es. registrazione, autenticazione). Questi cookies sono strettamente necessari e sono utilizzati per memorizzare un identificatore univoco al fine di gestire e identificare l’Utente in quanto unico rispetto agli altri Utenti che in quel momento stanno utilizzando l’App, in modo da fornire un servizio coerente e preciso.

Inoltre, questi cookies permettono all’App di ricordare le scelte degli Utenti (es. nome utente, etc...), di distribuire richieste su più server, di permettere agli Utenti di visualizzare contenuti e video tramite Adobe Flash Player.

Cookies Analitici

Questo tipo di cookies utilizzati dall’App sono cookies installati da terze parti quali Google Analytics, e raccolgono informazioni su come gli Utenti utilizzano l’App, ad esempio misurando e tenendo traccia dei contenuti e delle funzioni a cui gli Utenti hanno avuto accesso e/o visualizzato.

Questi cookies permettono così il miglioramento e perfezionamento dell’App, ad esempio stabilendo se gli Utenti riescono a reperire facilmente le informazioni desiderate, o individuando quali aspetti o funzionalità dell’App sono di maggiore interesse. Questi cookie vengono utilizzati dalla Società per elaborare analisi statistiche sulle modalità di accesso e utilizzo dell’App, sul numero di contenuti o funzioni a cui gli Utenti hanno avuto accesso o il numero di click effettuati su detti contenuti durante l’utilizzo dell’App. Questi cookies sono utilizzati dalla Società in maniera anonima adottando meccanismi di mascheramento dell’indirizzo IP degli Utenti e senza che Google Analytics possa incrociare tali informazioni con altre in suo possesso ai fini di identificare gli Utenti.

8. Modifiche alla Privacy e Cookie Policy

La Società si riserva il diritto di apportare modifiche alla presente Privacy e Cookie Policy in qualunque momento, dandone avviso mediante pubblicazione sul Sito. Invitiamo l’Utente a verificare sul Sito tali aggiornamenti.
Qualora i cambiamenti fossero particolarmente significativi e/o impattino in maniera elevata sui diritti dell’Utente, la Società potrà comunicarli all’Utente anche tramite una diversa modalità (per esempio l’invio di una email).

9. Data Protection Officer

This Privacy and Cookie Policy aims to describe the purposes and methods used by Openjobmetis S.p.A., with registered office located at Via Generale Gustavo Fara 35, Milan, Italy, in its role as Controller (“Company” or “Controller”), for the collection and processing of personal data relating to users (“User/Users”) who interact with the “BADAPLUS” app (“App”).
The “BADAPLUS” app (“App”), managed by Openjobmetis, is a platform aimed at facilitating the matching of employment offers and demand, allowing Family-Users (i.e. Openjobmetis clients that subscribe to the service), after downloading and registering their account, to promote the supply of manpower for the performance of a temporary Job, which will be offered to Worker-Users (i.e. the candidates for the job offers of Family-Users through Openjobmetis and who subscribe to the service) selected by the system according to professional characteristics, availability, and physical location.
The information contained in this Privacy and Cookie Policy is provided in accordance with EU Regulation No. 679 of 27 April 2016 (“Regulation”), with Italian Legislative Decree 196/2003 (“Privacy Code”), as well as the Regulations issued by the Italian Data Protection Authority (“Data Protection Authority”), and the Guidelines of European authorities.
Information regarding data processing is provided only for the App and the processing carried out by the Company, and does not extend to processing carried out by third parties via other websites that can be consulted by the User through links. The Company does not assume any liability with regard to this additional processing; the User must refer to the individual Privacy and Cookie Policies of the third-party websites.

1. Controller

The Company is the Controller, as indicated in the introductory paragraphs.

2. Purposes and legal basis for processing

The Company, as part of the supply and use of the App, may process data of Family-Users and Worker-Users for the following purposes.
a) Selection of Worker-Users to determine their personal characteristics and professional qualifications and the resulting eligibility for activation and use of the App by them.
b) Activation and operational management of the services offered by the App (e.g. User registration, account creation, publication of adverts relating to job offers directly by the Family-Users, applications by Worker-Users).
c) Profile activation, including in relation to the use of electronic signatures, also for the purposes of managing the related administrative-accounting purposes.
d) Management of the history regarding the profile of each Family-User and Worker-User.
e) Sending of notifications by the App with reference to job offers made by the Family-User and the related applications made by each Worker-User via push notifications on the User's mobile phone or by e-mail to the address specified on creation of the account, where the User has activated these options.
The legal basis for the mentioned processing is the performance of the service requested by you.
f) Pursuit of the legitimate interests of the Controllers and/or third parties (for example, the right of defence in court, claims and dispute management, debt collection, and the prevention of fraud and/or illegal activities), which are the legal basis for the processing.
g) Purposes connected to compliance with legal obligations, regulations, Italian and/or EU legislation as well as deriving from provisions issued by authorities authorised to do so by law, which are the legal basis for the processing.
h) Statistical purposes, and analyses regarding the use and functions of the App.

3. Categories of data subject to processing

Openjobmetis receives and collects personal data and information relating to Family-Users and Worker-Users who access the App and who use the available services, including through the entering and sharing of information and images between Users. In particular, Openjobmetis may acquire and process the following information via the App.

3.1 Data collected through browsing and cookies

When Users visit and use the App, the latter collects certain data, including the functions and content that the Users accessed, links or buttons clicked, the date and time of access, the IP address of the device and the operating system used (so-called “browsing data”). Browsing data could, by their very nature, enable Users to be identified, including through processing and associations with data held by third parties. However, Openjobmetis uses these data only for the purpose of obtaining statistical and anonymous information on the use of the App for purposes strictly connected to the functioning of the App.
Secondly, in relation to the collection of User data through cookies and similar technologies, please visit section 7 of this Policy.

3.2 Data provided voluntarily by the User

Worker-Users and Families decide, at their sole discretion, whether to apply for a job or accept an application, respectively. The preliminary identification data acquisition regarding Family-Users and Worker-Users, provided voluntarily in relation to the contract, occurs at the Openjobmetis offices in the presence of Openjobmetis personnel employed to obtain the profile of Users and enable the creation of the account, activated personally by each User.

As part of the services offered by the App, Users can provide additional personal data, as well as those indicated for the purposes above, such as for example, information provided in order to receive clarifications, support services etc. (for example, to ask for information, report poor service or malfunctions etc.). This information will be processed by Openjobmetis to allow feedback to be given to User requests. If these data are not provided, it may not be possible to obtain the requested service.

4. Communication of data to third parties

The data supplied by the User as well as those collected by the App as part of the related services (e.g. IP address) will not be disclosed, but may be communicated, for the purposes outlined in this Privacy and Cookie Policy, to the categories of subjects specified below:

• Openjobmetis Group companies for administrative purposes, for the pursuit of the legitimate interests of the Company and/or third parties and for the supply of the services explicitly requested by the User;
• in the case of a Family User, candidates for the job position being offered by the User and/or temporary workers of the Company, who the User intends to use for work activities;
• companies, partners, consultants or freelance professionals which the Company uses to perform the tasks of a technical or organisational nature (including, for example, suppliers of IT services), or with which the Company works for the purposes of the supply and functioning of its services, or for any communication activities;
• people, companies, or professional practices that provide support and consultancy to the Company, with particular, but not exclusive, reference to accounting, administrative, legal, fiscal and financial issues;
• subjects for which the right to access the data is recognised by legal provisions or orders of authorities.
Subjects belonging to the categories listed above will use the data in the role of independent controllers according to the law, or processors duly appointed by the Company.
These subjects can be located in Italy and/or EU countries.
The list of subjects to which the data are or can be communicated can be requested from the Company by e-mailing privacy@openjob.it.
5.   Data retention
User data will be retained for the time necessary for the pursuit of the purposes for which they were collected, and for the performance of activities connected and instrumental to these, as specified in the previous section 2. After this, they will be retained in compliance with the standard time periods identified by the Italian Civil Code or by specific legal provisions, for administrative purposes and/or to assert or defend a right in court or a legitimate interest. The data will be deleted once the purposes for which they were collected no longer apply.
Secondly, the personal data collected for the purposes of assessing the applications for internal positions within the Openjobmetis team will be retained for 12 months from receipt.
Finally, the data collected for the purposes of sending newsletters will be retained until the User unsubscribes/objects.
At the end of these periods, the data will be retained in anonymous form for analytical and statistical purposes.
6.   Rights
The User can exercise the rights set out by the Regulation in those cases expressly provided for by the law and where applicable. In particular, Users have the right to:
 ask for confirmation that there is ongoing processing of their personal data and, in this case, ask the Controller for access to information relating to the processing (e.g. purpose, categories of processed data, recipients or categories of recipients of the data, retention period, etc.);
 ask for amendment of any inaccurate or incomplete data;
 ask for the deletion of the data;
 ask for restriction of processing;
 receive the personal data concerning them in a structured and machine-readable format, and transmit those data to another controller, or ask for the direct transmission from one controller to another, if technically feasible (so-called “data portability”);
 withdraw their consent at any time, without prejudice to the lawfulness of the processing carried out before the withdrawal based on consent.
Users also have the right to completely or partially oppose the processing of their personal data for legitimate reasons, as well as the right to oppose at any time the processing of data for marketing purposes (including partially for individual channels).
These rights can be exercised directly by writing to the following e-mail addresses: privacy@openjob.it.
Finally, whenever it is considered that the processing of the personal data provided breaches personal data protection legislation, Users have the right to submit a complaint to the Italian Data Protection Authority (www.garanteprivacy.it).
7.   Data collection via cookies
A cookie is a short string of text, which visited websites send to the User's browser. They are stored when the User visits a website and then resent on the next visit.
Cookies are used by the Company for the functioning of its Website or to improve performance, but also to provide information on the Website or on the User's browsing.
The Website uses cookies both for technical purposes and for other reasons: while technical cookies are used in a way strictly necessary for the technical functioning of the Website as well as to provide the service specifically requested by the User (e.g. language settings, etc.), as better described below, cookies for other purposes (e.g. analytics cookies) are used to perform an analysis of the User's behaviour on the Website, as indicated below.
In addition to what is set out in the Privacy Policy, information regarding the processing of cookies within the App is reported below.
In principle, the App uses cookies both for technical purposes and for additional purposes: while technical cookies are used in a way strictly necessary for the technical functioning of the App as well as to provide the service specifically requested by Users (e.g. authentication, language settings etc.), as better described below, cookies for other purposes (e.g. analytics cookies) are used to perform an analysis of the User's behaviour on the App, in order to improve the content and monitor the preferences expressed by Users when using the App, as described below.
Technical Cookies
Technical cookies are essential to allow the User to move around the App and to use its functions, including for example, to access User accounts (e.g. registration, authentication). These cookies are strictly necessary and are used to store a unique identifier in order to manage and identify the User, who is unique compared to the other Users using the App at that time, so as to provide a consistent and accurate service.
Furthermore, these cookies allow the App to remember the User's choices (e.g. username, etc...), to distribute requests on multiple servers, and to allow Users to view content and videos via Adobe Flash Player.
Analytics Cookies
These cookies, which are used by the App, are installed by third parties, such as Google Analytics, and collect information on how Users use the App, for example, measuring and keeping track of the content and functions that Users have accessed and/or viewed.
These cookies therefore enable the improvement and fine-tuning of the App; for example, establishing whether Users manage to easily find the desired information, or identifying which aspects or functions of the App are of the most interest. These cookies are used by the Company to perform statistical analysis on the methods of access and use of the App, on the number of content and functions Users have accessed or the number of clicks made on the content during use of the App. These cookies are used by the Company anonymously, adopting mechanisms that mask the IP addresses of Users and so that Google Analytics cannot cross-check the information with other data held in order to identify Users.
8.   Changes to the Privacy and Cookie Policy
The Company reserves the right to make changes to this Privacy and Cookie Policy at any time, giving notice through publication on the Website. We invite Users to check these updates on the Website.
